Elana Zana is a member in the firm’s Business, Healthcare and Municipal Departments, where she maintains a dual practice with a focus on both healthcare and telecommunications.

Elana represents both healthcare providers and third-party vendors and software companies investing in healthcare on security and data governance strategy.  Elana works with clients in developing and implementing security compliance procedures that are effective security controls but recognize the work flow needs of clients.  She advises clients on data breach prevention and mitigation, including tailoring security policies and procedures for healthcare entities, municipalities and fire departments.  She also negotiates and drafts Health IT related software agreements and licenses, preforms Stark compliance audits, and advises small and large physician practices and ASCs.  For over a decade, Elana has also worked with clients on certificate of need strategy, applications and litigation.  

Elana is the chair of the OMW Telecommunications Team, and works with both municipal and private sector clients on telecommunications related legal issues. Elana’s strategy is to work cooperatively with telecommunications companies to drive practical solutions and enable deployment while respecting the aesthetic nature and protecting the local authority of the communities she represents. Specifically, Elana represents several consortiums of jurisdictions in negotiations with cable and telecommunications operators, and in representing these clients in litigation and FCC filings. She effectively communicates complex FCC and state law governing wireless deployments to her clients, so that they can manage these requirements within their permitting process, budget and development.  She represents municipal clients in drafting, negotiating and enforcing wireless communications facility franchises, agreements and code, drafting master cable and telecommunication ordinances, navigating permitting requirements, and wireless communication facility leases. Elana also represents private sector entities, including non-profit schools, synagogues and churches, on both cable and telecommunications related agreements and leases.  

Elana, a Seattle native, received a B.A. in Business Administration in 2004 from the University of Washington. She received her law degree, magna cum laude, from Seattle University School of Law in 2007, where she served as Business & Marketing Editor of the Seattle University Law Review. During law school, Elana also externed for Judge Zilly in the United States District Court for the Western District of Washington. Elana lives in Seattle with her husband, three children and labradoodle.
